These apply to all services offered by BET, particularly the organization of tours and excursions (hereafter referred to as “Tour(s)”) and guiding services, excluding those provided by third-party providers. In the case of services provided by third parties, BET acts solely as an intermediary, and such services are subject to the terms and conditions of the respective third-party providers. 2. **Booking and Contract Formation** To enter into a contract with Bengal Expedition Tours, you must be at least 18 years old and legally capable of entering into binding agreements under applicable law. Bookings can be made via various channels (such as the internet, travel agencies, hotels, etc.) by telephone, email, fax, or in person. A booking is required even for complimentary participation. Failure to make a booking may result in exclusion from the Tour, including in cases where a minor and their accompanying adult are involved. Once the booking is confirmed by BET, the contract is established, and both the Traveler and any third-party booker agree to these Terms and Conditions. Non-binding reservations will not be accepted. 3. **Information Required for Booking** For a valid booking, Travelers must provide the necessary information requested by BET, along with full payment. If required information (such as for air tickets, permits, or other inclusions) is not provided, an administrative fee may apply. Additionally, if this failure leads to missed inclusions or services, the Traveler will bear the associated costs. BET reserves the right to cancel the booking or related components if required information is not provided, and cancellation fees may apply. Travelers are responsible for ensuring that all information provided is accurate and complete. 4. **Pricing and Payment Terms** The Tour Price per person (hereafter referred to as the “Tour Fee”) is indicated in USD, inclusive of VAT. Prices are subject to change as outlined in Section 6, and the full payment is due at the time of booking. 5. **Cancellations / Modifications by the Traveler** BET does not offer cancellation insurance. For multi-day tours, cancellations must occur before the specified deadline on the invoice, as per the terms outlined there. In the case of non-refundable rates for hotel bookings, the Traveler agrees to the terms at the time of booking. Cancellations after the indicated payment deadline are subject to a 100% cancellation fee, except in cases of special conditions as specified in the invoice. Any changes to confirmed private tours are at BET’s sole discretion, and a handling fee may apply. 6. **Cancellation by BET** BET reserves the right to cancel a Tour due to unforeseen circumstances, including force majeure, weather hazards, government actions, political unrest, strikes, or similar events. Additionally, if the minimum number of participants for a tour is not met, BET may cancel the Tour. In such cases, BET will refund the full amount of the Tour Fee already paid but will not offer any further compensation. 7. **Price or Service Changes** BET reserves the right to alter the Tour Fee or itinerary due to extraordinary circumstances, such as increases in third-party service rates, new taxes, or unforeseen fees. Any price increase of more than 10% will entitle the Traveler to either cancel the booking for a full refund or choose an alternative Tour without additional fees. BET may also change the Tour program, shorten the duration, or provide an alternative solution if required by unforeseen circumstances. Any additional costs incurred will be the responsibility of the Traveler. In the case of significant changes, the Traveler may cancel the booking free of charge. 8. **Participation Terms** All Tours are subject to the specific terms published by BET, including language preferences, guiding services, and related details. The lead Traveler must present their identification or passport at check-in, and failure to do so may result in exclusion from the Tour without a refund. For international Tours, a valid passport is required. Minors must be accompanied by a legal guardian. Pets are not permitted, and Travelers are required to inform BET of any health issues. Travel insurance is recommended, covering health and accident risks, including sports activities if applicable. BET reserves the right to exclude a Traveler from a Tour if they fail to adhere to these Terms, exhibit health concerns, or cause disruption. Should a Traveler be excluded before the Tour commences, cancellation terms will apply. If exclusion occurs during the Tour, no refund will be provided, and further claims for damages are excluded. 9. **Liability** (i) **Limitation of Liability of BET Travelers participate in Tours at their own risk. BET’s liability is limited to the amount of the Tour Fee, and any direct damages caused by gross negligence or willful misconduct. Liability for minor negligence, consequential damages, and lost profits is excluded. BET is not responsible for personal belongings, including valuables, luggage, or equipment. (ii) **Exclusion of Liability for Third-party Providers and Force Majeure BET does not assume liability for third-party services or for circumstances beyond its control, such as force majeure, natural events, or schedule disruptions caused by transportation providers. Any claims for damages should be directed to the relevant third-party providers. (iii) **Traveler’s Liability Travelers assume full responsibility for their participation in activities, ensuring they are suited to their physical condition. BET expects Travelers to maintain personal responsibility and participate in activities with appropriate preparation, including proper equipment (e.g., clothing, footwear, and sunscreen). 10. **Claims Deadline** Claims against BET for non-performance or substandard performance must be submitted in writing within 30 days of the contracted Tour date, with a detailed explanation of the issue. Claims submitted after this period will not be accepted, except in cases where the Traveler can demonstrate that they were unable to meet the deadline due to circumstances beyond their control. 11. **Data Protection** By booking a Tour, Travelers consent to the collection of personal data, including name, contact details, and payment information, by BET. This information will be used for Tour-related purposes and may be shared with third-party providers as necessary. 12. **Severability** If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. In such cases, the invalid provision will be replaced with a valid one that most closely reflects the original intent. 13. **Governing Law and Jurisdiction** These Terms are governed by Bangladeshi law, excluding its conflict of law rules.
